EDIT: Seeing as how some of you reading this are no doubt here via Rich's column, I invite you to soak up the drama, observe how in the comments TO THIS VERY POST I say the whole thing was "likely miscommunication, and I challenge you to find any instance where I suggest the whole thing was malicious.
Then, BY ALL MEANS, go to My deviantART Gallery or My WebComicsNation.com Merchandise Page, and enjoy some art (my latest at dA is a commission for the lovely [livejournal.com profile] hawkward (Eisner Award-winning colorist Laura Martin).

In 2002, at San Diego CCI, I took a rather good picture of Gail Simone. I then watched said picture fly all over the place. Sometimes with my permission, as in Wizard, but most often not.

Last year, in June, I was contacted again for the picture by Gail. I sent it to Diana Schutz. Return correspondence from Schutz seemed to indicate that the picture was too lowres to be acceptable, I said I couldn't provide a larger file, Schutz never replied, and I figured that was that.

Imagine my surprise to see this:

That picture of Gail? That's my picture of Gail.
I'm more than a little unhappy about this. I have no contract for its use, I assumed it wouldn't be used. And, I freely admit, it'd bother me a lot less if I knew when people saw the picture, they went, "Oh, it's that pic of Gail that Lea Hernandez took."
So, now you do. I took it. It is rather nice. Gail looks fabulous in those glasses. It also belongs to me. So, when you see it, think, "That's a spanking picture of Gail that Lea took."

The title of the anthology? Desperately unfortunate, yes. Let's all agree on that and move on.

What is the usual cost for the use of a photograph?

EDIT: Let's be clear that the use of the picture was not Gail's call, nor do I blame her, nor do I think it's her fault. There was some confusion off-journal about that point.
